Since ASCA’s last update in January, healthcare organizations across the country posted 337 breaches of protected health information (PHI) affecting 500 or more individuals. Consistent with previous time periods, the vast majority of the breaches—95 percent—were caused by unauthorized access or hacking. On July 15, the Centers for Medicare & Medicaid Services (CMS) released the 2023 proposed payment rule for ASCs and hospital outpatient departments (HOPD). ASCA will once again submit comments raising industry-wide concerns, but it is important that CMS hears from individual centers as well. As a special member resource, ASCA staff have created several template comment letters that can provide a starting point if you wish to submit comments.

Today, the U.S. Food and Drug Administration announced the removal of N95 respirators from the agency's medical device shortage list, signaling that demand or projected demand for this type of face protection device commonly used in health care settings no longer exceeds the supply. This action is the result of increased domestic manufacturing of N95 respirators, as well as updates to the FDA's supply chain assessment based on engagement with industry and federal stakeholders, and the Centers for Disease Control and Prevention’s National Institute for Occupational Safety and Health's approval of new disposable N95s and reusable respirators.

Continued strong patient needs for blood have depleted Vitalant's supply by nearly 50 percent since the start of summer, creating an emergency shortage across the country. As the Labor Day holiday weekend approaches, when fewer donors are typically available, the nonprofit blood services provider to about 900 hospitals nationwide, urges all eligible donors to schedule an appointment now for the coming days and weeks. ­­­

On August 19, the Department of Health and Human Services Office of Inspector General posted a favorable advisory opinion, AO 22-16, with respect to the provision of gift cards to Medicare Advantage (MA) plan enrollees who complete certain steps in an online patient education program. This opinion underscores potential flexibility for with Medicare Advantage Organizations and their vendor partners to offer incentives to patients to engage in learning and health care engagement activities that may improve health outcomes without inappropriately steering patients toward particular providers or MA plans.
