On December 15, 2025, CMS will start a five-year prior authorization demonstration for certain services provided in ambulatory surgical centers in California, Florida, Texas, Arizona, Ohio, Tennessee, Pennsylvania, Maryland, Georgia, and New York. The service categories targeted by the demonstration are blepharoplasty, botulinum toxin injections, panniculectomy, rhinoplasty, and vein ablation procedures.

Multiple health groups and medical associations called on U.S. Health Secretary Robert F. Kennedy Jr. to step down in a joint statement on Wednesday, saying he was disregarding decades of lifesaving science and reversing medical progress. The statement, signed by more than 20 groups, comes after multiple former directors of the Centers for Disease Control and Prevention under both Republican and Democratic presidents have said that Kennedy's decisions - culminating in last week's firing of the CDC's director - are putting Americans' health at risk.

A federal judge has issued a permanent injunction against Johnson & Johnson’s Biosense Webster medical device unit, barring the company from blocking hospitals’ access to lower-cost, FDA-regulated reprocessed cardiac catheters. The ruling by U.S. District Judge James Selna in California follows a jury verdict that found Biosense Webster had engaged in unlawful, anti-competitive conduct and ordered it to pay $147 million in damages to Innovative Health LLC.

On July 15, the Centers for Medicare & Medicaid Services released the 2026 proposed payment rule for ASCs and hospital outpatient departments. ASCA will once again submit comments raising industry-wide concerns, but it is important that CMS hears from individual centers as well. The last day to submit comments online is next Monday, September 15.

Colorado’s statewide ban on physician noncompete agreements took effect last month, but that’s cold comfort for Amy Glaser-Carpenter, DO. The primary care physician left the state in 2017 because she was unhappy working at San Luis Valley Health, Alamosa, Colorado. Glaser-Carpenter, who loves the outdoors, wanted to hang her own shingle so she could remain in the valley, surrounded by its sand dunes and mountains.
