ASCA proudly supports new legislation titled Outpatient Surgery Quality and Access Act of 2021 (H.R. 5818 and S. 3132). Representatives John Larson (D-CT) and Devin Nunes (R-CA) introduced the legislation in the US House of Representatives and Senators Richard Blumenthal (D-CT) and Bill Cassidy, MD (R-LA) introduced the legislation in the US Senate.

As ASCA reported last week, the Centers for Medicare & Medicaid Services (CMS) has released its 2022 final payment rule for ASCs and hospital outpatient departments (HOPD). Of note, CMS finalized its proposal to reverse policy changes from the previous administration that added a significant number of codes to the ASC Covered Procedures List (ASC-CPL) and began the process of eliminating the inpatient-only (IPO) list, with a few modifications.

CMS Fact Sheet (11/02/21)
On November 2, 2021, the Centers for Medicare & Medicaid Services issued a final rule that includes updates on policy changes for Medicare payments under the Physician Fee Schedule (PFS), and other Medicare Part B issues, on or after January 1, 2022. The calendar year 2022 PFS final rule is one of several rules that reflect a broader Administration-wide strategy to create a health care system that results in better accessibility, quality, affordability, empowerment, and innovation.

FDA Medical Device Safety (11/02/21)
The U.S. Food and Drug Administration (FDA) recognizes the need for personal protective equipment (PPE), such as medical gloves, may outpace the supply available to health care organizations during the Coronavirus Disease 2019 (COVID-19) outbreak. This Letter to Health Care Providers refers specifically to potential shortages relating to surgeons' gloves and patient examination gloves.

The Biden-Harris Administration is requiring COVID-19 vaccination of eligible staff at health care facilities that participate in the Medicare and Medicaid programs. The emergency regulation issued by the Centers for Medicare & Medicaid Services today protects those fighting this virus on the front lines while also delivering assurances to individuals and their families that they will be protected when seeking care.

Carolina Coast Online (11/03/21)
A surgeon in New Bern recently performed North Carolina’s iris transplant and the patient was an active-duty Marine serving aboard Camp Lejeune. Officials with the CarolinaEast Surgery Center said Capt. Kamil Szmyglewski was critically injured in July 2020 in an accident while visiting Florida from Savannah, where he was previously stationed, when the rusty end of a flagpole struck his eye, severely lacerating the globe.
