The Centers for Medicare & Medicaid Services (CMS) announced earlier this month that it would expand survey operations for all CMS-certified providers and suppliers after the months-long suspension of routine survey activities. On August 25, ASCA joined other medical professional societies in sending a letter to Representatives Cindy Axne (D-IA) and Neal Dunn (R-FL) and Senator Marsha Blackburn (R-TN) in support of the Eliminating the Provider Relief Fund Tax Penalties Act of 2020 (H.R. 7819/S. 4525). If enacted, this would ensure that all healthcare providers, regardless of taxpaying status, would not be subject to taxes on aid provided through the Provider Relief Fund. Additionally, the bill would ensure that expenses attributable to the Provider Relief Fund are tax deductible.

FDA Medical Device Safety (08/28/20)
The U.S. Food and Drug Administration (FDA) is alerting health care facility risk managers, procurement staff, and health care providers that gowns sold as medical gowns, including surgical gowns, sold by Laws of Motion PPE (LawsofMotionPPE.com) have potential quality issues that affect the level of fluid barrier protection. The FDA is recommending that gowns manufactured or sold by Laws of Motion PPE should not be used as personal protective equipment at this time while the FDA continues our investigation.

The much-anticipated final rule updating physician self-referral and anti-kickback laws has been pushed back for one year, the Department of Health and Human Services announced this week. "We are still working through the complexity of the issues raised by comments received on the proposed rule," HHS Deputy Executive Secretary Wilma M. Robinson wrote in a public notice, "and therefore we are not able to meet the announced publication target date."

AMA News Release (08/27/20)
Responding to the exceptional challenges and demands that strain physicians during the COVID-19 pandemic, the American Medical Association (AMA) today announced a new series of open access educational modules offering proven strategies to support the well-being of physicians during a time of acute stress. "Just as we are able to flatten the COVID-19 infection curve through proactive use of masks, hand-hygiene and social distancing, it is necessary to take steps to protect against the drivers of workplace stress to reduce psychological injury involving health professionals," said AMA President Susan R. Bailey, M.D.

Today, under President Trump's leadership, the Centers for Medicare & Medicaid Services issued a proposed rule that unleashes innovative technology so Medicare beneficiaries have access to the latest, most cutting-edge devices. Today's action represents a step forward that will help demolish the existing bureaucratic barriers that have created a "valley of death" for innovative products, resulting in lag times and lack of access for America's seniors.
