Legislation



ASCA works with the United States Congress to ensure sound public policy is implemented concerning ASCs and their Medicare patients.

Because ASCs provide superior quality and timely patient care, it is imperative that the ASC industry work with Congress to ensure Medicare patients continue to have access to ASCs.

ASCA Issue Briefs

ASCA has developed issue briefs for members to use in talking with their legislators. We will continue to update these with the flow of regulatory and legislative events as well as adding new issue papers.

Previous Legislative Efforts

ASC Quality & Access Act of 2011 (H.R. 2108 / S. 1173)

The bill aimed to prevent the widening gap between ASC payments and hospital outpatient department payments for identical procedures and create a value-based purchasing system for ASCs.

Certain provisions of the bill were successfully implemented, including an appropriate reporting system to measure the high quality care that is provided in the ASC setting and the elimination of a limitation on performing procedures in ASCs on the same day that surgery is scheduled.
